This is a broad overview of complex law. The Fair Labor Standards Act is a federal law that applies to most employers in America. Even if the business might not be covered, many employees may still be covered. We will address who is covered by this law, which employees are “exempt” from the law, and recordkeeping requirements. Many employers pay employees a salary and mistakenly believe that they do not need to pay the employee overtime pay.  There is a test that involves more than paying a salary. We will deep dive into the most common white-collar exemptions and common errors employers make in both classifying workers, and also in paying workers. This will be a fast-moving session. The topic will be addressed in many slides. The presenter will use re-world examples to keep things interesting.

Areas Covered

3 things attendees will learn in this session:

  • Learn the most common errors employers make
  • Experience real-world examples to make the material come to life
  • Leave the session armed with the tools you need to properly classify and pay employees

Course Level - Basic/Intermediate

Who Should Attend

Human Resources, CFO, CEO, President, Vice-President

Why Should You Attend

This is the number one way that businesses get sued by their employees.  Ignorance of this complex law is not a defense. If you have attended training on things such as Title VII, ADA, ADEA, FMLA, etc, then you have gotten off to a good start, but FLSA is much riskier than those other laws.

This is one session that anyone running a business or in HR should attend.

Topic Background

This is the federal law that requires most employers to may workers minimum wage and overtime.
